Terms and Conditions for Hosted Email Service

Please read these Terms and Conditions ("Terms") carefully before using the Email Xpert Hosted Email Service ("Service") provided by Systems Xpert Pty Ltd. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Service Description

Systems Xpert Pty Ltd provides a Hosted Email Service that enables users to send, receive, and store email messages via our servers. Additional features may include spam filtering and virus scanning.

2. Account Registration

To use the Service, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Acceptable Use Policy

You agree not to use the Service:

We reserve the right to suspend or terminate accounts that violate this policy.

4. Service Availability

While Systems Xpert Pty Ltd aims to provide continuous access to the Service, we do not guarantee uninterrupted or error-free operation. Planned maintenance and unexpected issues may result in temporary downtime.

5. Data Security and Privacy

We take reasonable technical and organizational measures to protect the confidentiality and integrity of your email data. However, we cannot guarantee absolute security. Our Privacy Policy explains how we collect, use, and protect your personal data.

6. Data Retention and Backup

We perform routine backups to support service continuity, but we do not guarantee the recovery of deleted or lost data. Users are responsible for maintaining their own backups where needed.

7. Fees and Billing

Use of the Service may be subject to subscription fees or other charges as outlined in our Pricing Plan. Failure to pay on time may result in suspension or termination of the Service. All fees are non-refundable unless otherwise specified.

8. Domain Ownership

Systems Xpert Pty Ltd guarantees to transfer ownership of any domain names purchased and fully paid for by the customer to the customer’s individual account at the domain registrar of their choice upon request.

9. Storage Capacity

Our hosted email plans may be advertised with "unlimited storage"; however, this is subject to fair and reasonable use. In practice, “unlimited” means we do not enforce strict quotas for typical usage. However, Systems Xpert Pty Ltd reserves the right to determine what constitutes reasonable disk space usage. If your storage usage exceeds 30GB per mailbox, we may contact you to discuss options for reducing disk usage, such as archiving or deleting older files. We reserve the right to enforce limits or take other appropriate measures if usage is deemed excessive and may impact overall system performance.

10. Termination

You may terminate your account at any time. Systems Xpert Pty Ltd reserves the right to suspend or terminate your access to the Service at our discretion, particularly in the event of a breach of these Terms or discontinuation of the Service.

11. Limitation of Liability

To the extent permitted by law, Systems Xpert Pty Ltd shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service.

12. Modifications to Terms

We may update these Terms from time to time. Changes will be posted to our website and/or notified via email. Continued use of the Service following such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia and the laws of the State or Territory in which you ordinarily reside or receive the Service.
